Terms and Conditions for
SOS Teacher Agency

IT IS AGREED AS FOLLOWS:

 

1. Employment Assignments

1.1 The Employer, acting as the agent of the Teacher, will at its own expense, use its best endeavours to procure offers of employment ("Assignments") as                    described in the Assignment Schedule.

 

2. Notification of Assignment

2.1 In respect of each Assignment procured by the Employer as agent for the Teacher, once an Assignment is procured, the Employer will:
   2.1.1 Inform the Teacher, by telephone, electronic notification, or in person, at the option of the Employer, of the specific terms of the Assignment, including                 but not limited to time, date, place, job classification, duration, and payment to the Teacher; and
   2.1.2 Attempt to provide the Teacher with as much notice as is reasonably possible regarding the start date and time of the Assignment.

 

3. Assignment Schedule

3.1 Upon receiving acceptance of an Assignment from the Teacher, either by telephone, in person, or by electronic notification, the Employer will, if                                necessary, send the respective Client School the Assignment Schedule by email.


3.2 The Assignment Schedule will detail:
   3.2.1 The name of the Teacher;
   3.2.2 The Victorian Institute of Teaching (VIT) registration number;
   3.2.3 The name of the Client School;
   3.2.4 The specific duties the Teacher is to perform;
   3.2.5 The dates of the Assignment;
   3.2.6 The time to be worked in days and hours (one day = 6 working hours, excluding lunch).

 

4. Teacher’s Obligations

4.1 The Teacher authorises the Employer to procure Assignments and to represent to any potential Client School that the Teacher will adhere to the                             Victorian Institute of Teaching (VIT) Standards of Professional Practice and Code of Ethics.


4.2 The Teacher agrees to:
   4.2.1 Punctually attend the designated place of employment for the Assignment 30 minutes prior to its commencement, or as soon as practicable if                                 arranged on the same day;
   4.2.2 Attend class punctually for lessons or other activities as directed by the Client School or its authorised employees;
   4.2.3 Diligently carry out all duties required by the Client School in accordance with best professional standards;
   4.2.4 Use their best endeavours, professional experience, skill, and knowledge to perform all duties required;
   4.2.5 Complete all necessary preparation prior to the Assignment;
   4.2.6 Teach the materials provided by the Client School, or where none are provided, deliver lessons appropriate to the pupils' age and ability, and in                                  accordance with the Client School's curriculum.


4.3 The Teacher agrees to further undertake:
   4.3.1 Setting homework in accordance with the Client School’s policies;
   4.3.2 Marking and assessing classwork and homework in accordance with Client School policies;
   4.3.3 Assisting with non-teaching duties as directed by the Client School;
   4.3.4 For Assignments longer than four weeks, assisting with activities such as writing reports, completing assessments, attending parent meetings, and                       attending staff meetings.


4.4 Upon completion of the Assignment, the Teacher will:
   4.4.1 Leave notes on the work covered during the Assignment;
   4.4.2 Ensure the classroom is left in a tidy condition;
   4.4.3 Ensure that all pupils have safely left the premises before departing at the end of the school day.


4.5 The Teacher will obey all lawful and reasonable instructions given by the Client School and its authorised employees, including those regarding OHS and             Worksafe practices.


4.6 The Teacher will familiarise themselves with the Client’s OHS policies and report any unsafe work areas to the OHS Officer.


4.7 The Teacher will observe all lawful rules, customs, and procedures of the Client School, including discipline, equal opportunities, and privacy laws.


4.8 The Teacher will accept that the Client School and its authorised employees have final control over the manner in which duties are performed.


4.9 The Teacher will dress in accordance with normal professional standards.


4.10 The Teacher will use school resources only where essential to the Assignment.


4.11 The Teacher will not use school resources for personal purposes unless in an emergency and only with permission from the Client School or its                                   authorised employees.


4.12 The Teacher will immediately notify the Employer if they are unavailable to attend any previously accepted Assignment, either before it starts or during                 its intended duration.

 

5. Assignment Acceptance

5.1 The Employer cannot accept any Assignment on behalf of the Teacher without first referring it to the Teacher and receiving specific instructions to accept          it.

 

6. Information Dissemination

6.1 The Teacher authorises the Employer to disseminate relevant information to School(s) that the Employer deems necessary for the procurement of                          Assignments.


6.2 The Teacher consents to the Employer providing relevant personal information, including their Victorian Institute of Teaching (VIT) registration number,               to the Department of Education and Training (DET) or other authorities for the purpose of verifying the Teacher’s eligibility for employment in Victorian                 Government schools.

 

7. Payment

7.1 The Teacher authorises the Employer to provide the Teacher with a net salary after deduction of any government charges, taxes, duties, or levies required            by law.

 

8. Salary Agreement

8.1 The Teacher agrees to the salary level allocated by the Employer in accordance with the current Educational Services (Teachers) Award, commensurate                 with years of teaching experience.


8.2 The onus of providing satisfactory evidence of teaching experience lies with the Teacher. The Employer retains the right to request evidence and refuse                unsatisfactory evidence.

 

9. Multiple Representation

9.1 The Teacher acknowledges that nothing in this Agreement prevents the Employer from acting as an agent for other persons, including prospective Client           Schools.

 

10. Termination

10.1 Either party may terminate this Agreement by providing seven (7) days’ written notice via post or email to the last known address of the other party.

 

11. Accuracy of Information

11.1 The Teacher warrants that all particulars set out in the Schedule are true and correct in every detail. The Employer will rely upon the accuracy of this                       information in carrying out its obligations.

 

12. Non-Compete Clause

12.1 The Teacher agrees not to undertake any work for a Client School for six (6) months after completing an Assignment unless prior written consent is given             by the Employer. The Client School is bound by the same conditions.

 

13. Confidentiality

13.1 This Agreement is confidential and will not be disclosed except for legal advice or in relation to procuring Assignments, provided that prospective Client               Schools agree in writing not to disclose the information.

 

14. Interpretation

14.1 References to "its" will mean either "his" or "her," as applicable, and the singular will include the plural and vice versa.

 

15. Entire Agreement

15.1 This Agreement constitutes the entire understanding between the parties and supersedes all previous agreements.

 

16. Modifications

16.1 No amendments or modifications to this Agreement will be binding unless made in writing and signed by both parties.

 

17. Severability

17.1 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in full effect.

 

18. Governing Law

18.1 This Agreement is governed by the laws of the State of Victoria.

 

19. Dispute Resolution

19.1 Any disputes arising under this Agreement will first be referred to mediation. If no agreement is reached, the matter will be submitted to the competent

          courts of the State of Victoria.
